Title: Prohibits Employers from Requiring Employees to Join or Pay Unions
Vote to pass a bill that prohibits employers from requiring their employees join or pay charges to a labor organization.
- Prohibits employers from requiring an individual, as a condition of employment, to do any of the following (Sec. 1):
- Become or remain a member of a labor organization;
- Pay charges of any kind or amount to a labor organization; or
- Pay to a charity or third party an amount that is equivalent to or a proportion of charges required of members of a labor organization.
- Defines an “employer” as either a person employing at least 1 individual in Indiana or an agent of such a person (Sec. 1).
- Defines a “person” as being any of the following (Sec. 1):
- An individual;
- A proprietorship;
- A partnership;
- A firm;
- An association;
- A corporation;
- A labor organization; or
- Another legal entity.
- Defines a “labor organization” as an organization, agency, employee representation committee or a union that exists to assist employees in negotiating with employers their terms or conditions of employment (Sec. 1).
- Exempts the following from the provisions of this bill (Sec. 1):
- An employee of the United States or a wholly owned corporation of the United States;
- An employee or employer subject to the federal Railway Labor Act;
- An employee employed on property over which the United States government has exclusive jurisdiction for the purpose of labor relations;
- An employee of the state; or
- Employees of a municipal corporation or special taxing district.
- Specifies that the provisions of this bill apply to any active agreement beginning March 15, 2012 (Sec. 2).
