Miller Commends Today's VA Federal District Court Ruling on ObamaCare Law

U.S. Congresswoman Candice Miller (MI-10) today commended the decision by Virginia Federal District Judge Henry Hudson declaring that the individual mandate included in the recently passed health care law is un-Constitutional. In response, Congresswoman Miller released the following statement:

"Throughout the debate on the health care law, I have stood firm in my position that Congress had no authority to impose a mandate that an individual purchase health insurance. The Constitution limits Congress to specific enumerated powers and Congress has no authority to legislate outside the bounds of those powers. While the Constitution does grant Congress the authority to regulate interstate commerce, the Supreme Court has never interpreted that to force an individual to buy a product and participate in interstate commerce against his or her will. The individual mandate clearly crosses this line

"I commend Judge Hudson for his well considered opinion. Since this issue is so vital to the national debate over health care, I urge the Administration to join with the Attorney General of Virginia and call on the United States Supreme Court to quickly take up this case and settle this debate once and for all."
