Rep. Sherrill Votes to Prevent Attempts to Subvert Presidential Election Results

Statement

Date: Sept. 22, 2022
Location: Washington, D.C.

Representative Mikie Sherrill (NJ-11) voted for the Presidential Election Reform Act (PERA), bipartisan legislation that will reform the Electoral Count Act to ensure that Congress counts the votes as required by the Constitution. The reforms do not benefit either political party. PERA will help fix the Electoral College process to ensure votes are fairly counted.

"Our nation must learn from the pitfalls we saw when certifying the election on January 6, 2021, to ensure they never happen again," said Rep. Sherrill. "I proudly voted for bipartisan legislation to prevent future efforts to unlawfully overturn presidential elections and to secure future peaceful transfers of power that are a hallmark of our democracy. I urge the Senate to immediately take up this legislation for a vote - Congress has a duty now to clarify and repair this process to ensure it is never again disrupted."

The Presidential Election Reform Act protects our democracy and ensures the fair counting of votes by:

Enacting clear, comprehensive counting rules that make the following important reforms:

Reaffirm that the vice president's role at the count is ministerial;

Raise the objection threshold to one-third of each house (up from a single member of each house); and

List the explicit Constitutional grounds upon which Members may object to a state's electoral votes;

Ensuring that Congress receives a single, accurate certificate from each state;

Requiring states to select electors pursuant to state laws as they exist prior to Election Day;

Ensuring that presidential elections are only extended for genuine catastrophic events; and

Prohibiting election officials from refusing to certify presidential elections.
