Biden Administration Seeks to Repeal Migratory Bird Treaty Act Rule

U.S. Senator Kevin Cramer (R-ND), a Senate Environment and Public Works (EPW) Committee member, issued the following statement today on the Biden Administration's proposed rule to repeal the Trump Administration's Migratory Bird Treaty Act rule:

"It's a shame the Biden Administration wants to throw out commonsense regulations which would provide North Dakota companies much-needed clarity after they were unfairly prosecuted in recent years. That litigation was brought because of the Obama Administration's clear bias against the fossil fuel industry, and it appears President Biden's team is eager to pick up where they left off. North Dakotans should make their voices heard and let Biden Administration officials know about the problems their proposal would cause."

In 2011, the Obama Administration's U.S. Attorney in North Dakota attempted to use an "expansive interpretation" of the Migratory Bird Treaty Act to punish three oil companies where birds unwittingly died on their property. There was no intent to kill or harm the birds, yet the federal government tried to punitively prosecute them to the fullest extent.

Senator Cramer worked with the Trump Administration to craft its rule and slammed the Biden Administration for placing a hold on it earlier this year. Learn more here.
