Vote to concur with House amendments and pass a bill that requires school district boards to develop policies prohibiting the sale of non-nutritional beverages at all elementary, middle, and high schools in the state by no later than July 1, 2009.
Highlights:
- Requires each school district board of education and the state charter school institute to implement policies banning the sale of beverages in cafeterias, vending machines, schools stores, and fund-raising activities on campus if they do not meet the minimum science-based nutritional requirements (Secs. 3 & 6).
- Mandates that nutrition requirements be established by a national organization that promotes nutritional standards for beverages served specifically to students, and has distributed a memorandum of understanding between schools and the beverage industry concerning the school beverage policies [sec. 3 (2) (a) & sec. 6 (2) (a)].
- Applies beverage selling restrictions to regular and extended school days, including extracurricular activities and childcare programs [sec. 3 (3) & sec. 6 (3)].
- Permits the state board of education and the charter school institute to establish exceptions to the restrictions on the sale of beverages for special events occurring outside of the regular and extended school day by no later than November 15, 2008 [sec. 3 (2) (b) & sec. 6 (2) (b)].
- Amendment No.1, sponsored by the House Education Committee, changes the deadline for adopting policies on the sale of beverages in schools from September 1, 2008 to July 1, 2009, establishes a more detailed criteria of the national organization that the board will use to establish the nutritional standards for beverages, and allows for exceptions to the new restrictions for special school events.
