Title: Authorizing Physicians to Refuse Prescriptions

Vote Smart's Synopsis:

Vote to pass a bill that would prohibit requiring a pharmacist to dispense or sell a drug or medical device if the pharmacist believes that the drug or medical device would be used to cause an abortion or cause the death of a person by means of assisted suicide, euthanasia, or mercy killing.

Highlights:
- Specifies that if an employer is convicted of pharmacy discrimination, the Indiana board of pharmacy may assess against the employer a fine of not more than $5,000 for a first offense and $10,000 for every subsequent violation thereafter [sec. 5.5 (e)]. - Requires a pharmacist to contact the prescribing physician to clarify the clinical condition of the patient and the appropriateness of the prescribed drug or medical device before refusing to dispense the drug or device [sec. 5.5 (a)].
