Title: Fix Gun Checks Act of 2016
Vote on a motion to invoke cloture on an amendment to HR 2578 that amends the background check system for gun purchases.
Establishes that within 1 year, the Attorney General with the coordination of the states to implement a records recording system plan, made available to the National Instant Criminal Background Check System.
Requires that each such plan shall include the following annual benchmark goals in order to enable the Attorney General to assess implementation of the plan (Title VI, Sec. 611):
A qualitative goal; and
Quantitative measures.
Amends HR 2578 by adding “adjudicated as a mental defective” to the bill text (Title VI, Sec. 613).
Prohibits an individual who has been “adjudicated as a mental defective” from applying for relief from disability in the 180 days prior to the enactment of this act (Title VI, Sec. 613).
Prohibits any non licensed manufacturer or dealer from transferring a firearm to any other person who is not licensed (Title VI, Sec. 622).
NOTE: INVOKING CLOTURE REQUIRES A 3/5 MAJORITY OF THE SENATE. IT IS NOT A VOTE ON THE PASSAGE OF THE PIECE OF LEGISLATION, BUT LIMITS FURTHER DEBATE TO 30 HOURS. CLOTURE IS TYPICALLY USED TO END A FILIBUSTER. A FAILED CLOTURE VOTE OFTEN PREVENTS THE LEGISLATION FROM EVER COMING TO A VOTE.
