Title: Prohibits Picketing in Certain Circumstances
Vote to pass a bill that prohibits picketing in certain areas and prohibits employers from requiring employees to join a labor organization.
- Prohibits targeted picketing of private residences when such picketing interferes with the resident's right to “quiet enjoyment” or is intended to have the effect of violence or “intimidation” (Sec. 1).
- Exempts picketing of private residences which are places of employment when the picketing targets such employment from the provisions of this bill (Sec. 1).
- Specifies that the fine for individuals found picketing in violation of this bill on a second or subsequent occasion is $1,000 per day for every day of the second violation (Sec. 1).
- Specifies that the fine for organizations or groups found picketing in violation of this bill is $10,000 for every day of the violation (Sec. 1).
- Authorizes the courts to convict an individual of both conspiracy to commit criminal trespass and the actual offense of criminal trespass, whereas existing law did not authorize a conviction of conspiracy to trespass (Sec. 5).
- Classifies conspiracy to commit criminal trespass as a high and aggravated misdemeanor if the person is convicted of both conspiracy to commit criminal trespass and the actual offense of criminal trespass (Sec. 5).
- Prohibits employers from requiring employees to join a labor organization as a condition of employment (Sec. 2).
- Prohibits employers from witholding any amount of employee wages or earnings for payment to a labor organization without a written authorization from the employee which must be renewed annually, and which may be withdrawn at any time (Secs. 3 & 4).
