Constitutional Amendment - Amendment Adopted (Senate) (40-16) - March 19, 2012 (Key vote)
Title: Authorizes the State to Approve Charter Schools
Vote to pass a resolution that submits a constitutional amendment to the voters to clarify the authority of the state in establishing "special schools."
- Defines “special schools” as public schools that may include state charter schools (Sec. 3).
- Authorizes the General Assembly to (Sec. 3):
- Provide by law for the creation of “special schools” in such areas as may require them; and
- Authorize local boards of education to participate in the establishment of such schools under its own terms and conditions.
- Authorizes the state to expend state funds for the support and maintenance of “special schools" (Sec. 3).
- Prohibits the General Assembly from collecting a school tax for the support of “special schools” without the approval of the local board of education and a majority of the qualified voters voting in each system affected (Sec. 3).
- Defines “state charter school” as a public school that operates under the terms of a charter between the State Board of Education and a charter petitioner, but does not include private, sectarian, religious, or for-profit schools or private educational institutions (Sec. 3).
- Authorizes the state to utilize state funds for the support and maintenance of “special schools" (Sec. 3).
- Prohibits the state from utilizing local school system funds for the support and maintenance of “special schools" (Sec. 3).
