Vote to adopt a conference report that authorizes appropriations for the Department of Defense for fiscal year 2012.
Highlight: -Authorizes the Armed Forces of the United States to detain covered persons in military custody pending disposition under the law of war (Secs. 1021 & 1022). -Requires the Armed Forces of the United States to detain in military custody, pending disposition under the law of war, covered persons that meet the following criteria, unless the president waives the requirement of military custody due to "national security interests" (Sec. 1022):
- -Are captured in the course of hostilities;
-Are determined to be a member of al-Qaeda or an "associated force"; and
-Are determined to have participated in planning or carrying out an attack on the United States or its coalition partners.
- -Any person who planned, authorized, committed, or aided the September 11, 2001, terrorist attacks or harbored those responsible; or
-A person who was a part of or substantially supported forces that are engaged in hostilities against the United States or its coalition partners including, but not limited to, al-Qaeda and the Taliban.
- -Detention under the law of war without trial until the end of hostilities;
-Trial in a military court;
-Transfer for trial by an alternative court or tribunal; or
-Transfer to the custody or control of a foreign country or entity.
