SENATE BILL NO. 195

 

 

AN ACT TO AMEND TITLES 4 AND 15 OF THE DELAWARE CODE RELATING TO ALCOHOL SALES ON ELECTION DAYS.

 


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


Section 1.  Amend §709 (b) of Title 4 of the Delaware Code by deleting the phrase “or in any territory where an election is held during the hours of the day upon which the polling at such election takes place,”.

Section 2.  Amend §709 (d) of Title 4 of the Delaware Code by deleting the phrase “Easter; and the hours of the day during which the polls are open for voting in any territory where an election is being held, except for the elections specified in subsection (g) of this section” and replacing said phrase with the words “and Easter”.

Section 3.  Amend §709 (g) of Title 4 of the Delaware Code by deleting said subsection in its entirety and re-lettering the remaining subsections.

Section 4.  Amend §3112 of Title 15 of the Delaware Code by deleting said section in its entirety.


SYNOPSIS

            This Bill would allow the sale of alcoholic liquors in establishments licensed for sale for consumption off of the premises where sold, typically package stores, on all election days, general, primary, and special.
