Gov. Nixon Vetoes House Bill 209 Relating to Agricultural Nuisances

Gov. Jay Nixon today vetoed House Bill 209. In his veto message, the Governor said provisions of the bill relating to standing and successive lawsuits would apply to all types of nuisances, as opposed to the stated intent of the bill to apply only to nuisances relating to crop or animal production.

In addition, the legislation would have prohibited the ability to recover punitive damages in an agricultural nuisance action.

"My office has communicated with the House sponsor, and we are working with legislative leaders to clarify and improve the language of the bill in the time remaining in this legislative session," Governor Nixon said.
