TALLAHASSEE-Governor Jeb Bush today made the following statement regarding the First District Court of Appeal decision in Florida Department of Education v. Cooper:

"I am pleased that the First District has ruled in support of the Department of Education's 20-year policy on test confidentiality.

"The Florida Comprehensive Assessment Test (FCAT) has been a catalyst for student achievement and today's decision allows us to maintain meaningful standards, while giving parents and educators the ability to monitor student learning gains. As a result, Florida will continue to accurately measure students' progress in fundamental education subjects, rather than their ability to memorize material."

Excerpt from the opinion:

"We are asked to decide whether Florida Comprehensive Achievement Test (FCAT) test instruments, consisting of the test booklet and questions, as distinguished from the test score, are 'student records,' as that term is defined by Florida law. We find they are not and reverse."
