Congressman Cohen Defends Precedents Extending Civil Rights

Congressman Steve Cohen (TN-09), Chairman of the Judiciary Subcommittee on the Constitution, Civil Rights, and Civil Liberties, today questioned expert witnesses at a hearing entitled "What's Next: The Threat to Individual Freedoms in a Post-Roe World."

In his questioning of witnesses, the Congressman asked witness Catherine Glenn Foster, president of Americans United for Life, about the Supreme Court's rulings in Loving v. Virginia, which invalidated prohibitions on inter-racial marriage, and Obergefell v. Hodges, which legalized gay marriage. He asked:

"Do you agree that Loving v. Virginia is indistinguishable from Obergefell and, if taken up as Justice Clarence Thomas suggested, that it could be, and probably would be, struck down?...There's nothing more unethical than the court in the United States saying you can't marry the person you want to because of race or because of gender."
