Rep. Fischbach Statement on SCOTUS Leak

Statement

Date: May 3, 2022
Location: Washington, DC
Issues: Abortion

Tuesday, Congresswoman Michelle Fischbach (MN-07) released the following statement after the leak of a Supreme Court draft opinion on the Dobbs v. Jackson case:

"This leak is a seismic and foundational compromise of the independence of the Supreme Court. I have faith that our Supreme Court Justices will not bow to intimidation tactics and will adhere to the oath they took upon being sworn in, to 'faithfully and impartially discharge and perform the duties' incumbent upon them under the Constitution. I support Chief Justice Roberts' call to investigate this leak, and hope for a swift resolution."

"If the Supreme Court does decide to overturn Roe v. Wade, it will put the laws back in the hands of the states to be debated and decided by the American people and their elected representatives, not by unelected judges. This is a deeply needed step to protect the most precious and basic right, the right to life."

Background: The Supreme Court is expected to release a ruling on the Dobbs v. Jackson Women's Health Organization case in the coming weeks. An early draft of an opinion from a Justice was leaked to the press Monday night, which appeared to overturn Roe v. Wade and return the regulation of abortion services to the states. Chief Justice Roberts has confirmed the authenticity of the document but has stated it does not represent a view of any plurality or individual judge. He has since urged the Marshal of the Supreme Court to investigate the source of the leaked draft.
