Bishop, Jordan, & Judiciary Republicans Demand DOJ Stop Discriminatory COVID Treatment Allocation

Today, Rep. Dan Bishop (NC-09), Rep. Jim Jordan (OH-04), and 14 House Judiciary Republicans, sent a letter to Attorney General Merrick Garland demanding the Department of Justice (DOJ) take action against the U.S. Food and Drug Administration's (FDA) race-based guidance for monoclonal antibody treatment allocation:

"Discriminating who gets life-saving monoclonal antibody treatments on the basis of race is unacceptable and un-American. But that is what President Biden's FDA guidance does. Denying life-saving medical treatment to anyone because of their race is a clear violation of the 14th Amendment. The Department of Justice should be protecting Americans from such unlawful discrimination, and I am demanding AG Garland do so immediately," said Rep. Dan Bishop.

In December, President Biden's FDA issued appalling guidance to state and local health departments to allocate life-saving monoclonal antibody treatments on the basis of race. Based upon this guidance, several states such as New York, Minnesota, and Utah, have already prioritized race over high-risk medical conditions for allocating these treatments. The DOJ should be protecting the rights of all Americans from such discriminatory actions, and Judiciary Republicans are demanding to know what action AG Garland has taken on this issue.
