Bustos Votes to Protect Job Applicants from Age Discrimination

Today, Congresswoman Cheri Bustos (IL-17),voted to pass the Protect Older Job Applicants Act (POJA) which would codify and clarify protections for older job applicants in the current Age Discrimination in Employment Act (ADEA).

"No one should face discrimination when applying for a job, and that includes older Americans. Today, we passed critical legislation to help protect job applicants from age-based bias," said Congresswoman Bustos. "As we build our economy back better than ever, we need to make sure that every American can share in that progress. This bill is an important step in making that happen."

Over the last five years, two federal circuit court decisions, Villareal v. RJ Reynolds Tobacco Company and Kleber v. CareFusion Corp., ruled that some provisions of the ADEA's federal anti-age discrimination protections only applied to current employees, not job applicants. The POJA Act seeks to rectify these decisions to specifically include job applicants as protected under the ADEA.
