Committee Members Celebrate Vacating of EPA Rule to Censor Science

On Monday, U.S. District Court Chief Judge Brian Morris for the District of Montana granted the Biden Administration's motion to vacate the Environmental Protection Agency's (EPA) final rule for "Strengthening Transparency in Pivotal Science Underlying Significant Regulatory Actions and Influential Scientific Information." This decision follows Chief Judge Morris's ruling last week that the rule was illegally fast-tracked and inappropriately classified as a rule of internal agency procedure. The decision strikes down the rule immediately.

Chairwoman Eddie Bernice Johnson (D-TX), Rep. Suzanne Bonamici (D-OR), Rep. Don Beyer (D-VA), Rep. Bill Foster (D-IL), Rep. Mikie Sherrill (D-NJ), and Rep. Paul Tonko (D-NY) made the following statement.

"By vacating this harmful rule, the court has delivered an important victory to the American people, who can trust that environmental regulations will be made based on the best available science. Since 2014, Democrats on the Committee have fought against both legislative and regulatory efforts to stifle EPA's ability to protect public health under the guise of "transparency." We along with the environmental and public health advocacy community, legal scholars, and concerned citizens celebrate the final defeat of this anti-science, anti-health initiative."
