Pelosi Statement on House Filing Rehearing Petition in McGahn Case

Speaker Nancy Pelosi issued this statement after the House Judiciary Committee filed a petition for an en banc rehearing before the U.S. Court of Appeals for the D.C. Circuit in its litigation to enforce its lawful subpoena compelling former White House Counsel Don McGahn to testify:

"The divided Court of Appeals ruling in the McGahn case clearly contradicts bedrock law and binding legal precedent. As the House brief states, "The panel's decision has no support in the text or structure of the Constitution or in Supreme Court precedent.'

"This unprecedented ruling threatens to gravely undermine the House's ability to perform its Article I legislative oversight responsibilities and represents a direct challenge to our Constitution's system of checks and balances -- particularly in light of this Administration's blanket defiance and obstruction of Congress's constitutional legislative oversight authority.

"The full Court will now have the opportunity to rehear this case, remedy this misguided and dangerous ruling and uphold our Constitution's system of checks and balances. The House will continue to honor our responsibility to exercise our constitutional authority to conduct legislative oversight on behalf of the American people, including by issuing our lawful and legitimate subpoenas. The American people deserve the know the truth."
