Collins files amicus brief in Second Amendment case

Rep. Doug Collins (R-Ga.), Ranking Member of the House Judiciary Committee, today submitted an amicus brief on behalf of more than 90 members of Congress requesting the Supreme Court grant certiorari in Worman v. Healey. In this case, the petitioners alleged a Massachusetts ban on the sale of certain firearms and large capacity magazines violates the Second Amendment. If granted, the Supreme Court would hear the case.

The brief outlines several concerns, including that lower courts have not faithfully followed Supreme Court precedent, as established in District of Columbia v. Heller and McDonald v. City of Chicago, when hearing Second Amendment cases.

"Our legal system must preserve the constitutional rights of law-abiding citizens, but I'm concerned lower courts are not faithfully applying Supreme Court precedent in Second Amendment cases. I join more than 90 members of Congress in asking the Supreme Court to take up the Worman case to protect the constitutional liberties of all Americans and reinforce the position the Court has already espoused in the Heller and McDonald cases: The right to keep and bear arms is a fundamental right," said Collins.
