EPA Grants Gov. Heineman's Request to Allow Sales of High-Sulfur Diesel

The U.S. Environmental Protection Agency (EPA) has granted Gov. Dave Heineman's request for a waiver of regulations to allow the sales and over-the-road use of higher-sulfur-content diesel fuel in Nebraska through the end of the year.

Higher-sulfur-content diesel fuel in the state's fuel distribution system on or before Nov. 13 can be sold until supplies are exhausted.

"I am pleased for Nebraska farmers and truckers who depend on an adequate supply of diesel fuel that the EPA has recognized the extreme and unusual circumstances impacting the bottom line of individuals and businesses," Gov. Heineman said. "I am especially grateful for the speed of the federal response."

EPA had allowed the sales of higher-sulfur-content diesel fuel in Nebraska following Hurricanes Katrina and Rita. Those waivers expired Oct. 5. The Governor requested the new waiver to help offset diesel supply challenges across the state.
