Rep. Ross Praises Court's Rejection of CFPB Overreach in Leadership Dispute

U.S. Rep. Dennis A. Ross (R-FL-15), Senior Deputy Majority Whip and member of the House Financial Services Committee, praised U.S. District Court Judge Timothy Kelly's ruling that denies Leandra English, who was named last week as acting director by outgoing CFPB chief Richard Cordray, a temporary restraining order to block OMB Director Mick Mulvaney from assuming the role of acting director of the Consumer Financial Protection Bureau.

"The Court was right to strike down former Director Cordray's overreach in attempting to name a successor, and I am glad to see this refutation of the CFPB's rich tradition of ignoring the will of the people and the rule of law," said Rep. Ross. "Now is the time for the Trump administration and my colleagues in Congress to reform this unaccountable agency and prevent such a debacle from ever happening again."

Judge Kelly also noted there was not a substantial likelihood that the case would succeed on its merits. The Vacancies Reform Act empowers the president to fill a vacancy at an executive agency.
