McCaskill Issues Statement Following Arrest of Former Insys Therapeutics CEO John Kapoor

U.S. Senator Claire McCaskill, the top-ranking Democrat on the Homeland Security and Governmental Affairs Committee, issued the following statement after reports that John Kapoor, the former CEO of opioid manufacturer Insys Therapeutics, was arrested on multiple federal charges:

"Evidence from our investigation suggests that Insys was engaged in systemic fraud and took actions that directly harmed their own customers and public health as a whole. This company has repeatedly gotten away with fines that amounted to a slap on the wrist for actions that helped fuel a nationwide epidemic that's claimed hundreds of thousands of American lives. Anyone, including top executives, who potentially violated criminal law should be aggressively prosecuted."

McCaskill launched the most comprehensive Congressional investigation into the opioid crisis to date earlier this year, requesting documents from opioid manufacturers and distributors. In September, McCaskill announced the first round of findings, detailing systemic manipulation of the prior authorization process by Insys Therapeutics. Her report describes the emphasis Insys Therapeutics put on boosting approvals for its highly addictive fentanyl drug Subsys, even for inappropriate, off-label uses, and details an audio recording in which an Insys sales representative misidentifies herself and uses language designed to circumvent the prior authorization process.
