Huelskamp Stands with House Colleagues Against Obama's "Tyranny"

On Tuesday, The Separation of Powers Restoration Act, a bill cosponsored by Congressman Tim Huelskamp (KS-01), passed the House. The Separation of Powers Restoration Act (SOPRA) seeks to restore the balance of power among the three branches as the Constitution dictates.

In 1984, the Supreme Court established the Chevron Deference, which gives agencies in the executive branch authority to interpret "ambiguous" laws.

"Obama has used this ruling to undermine the separation of powers and unleash "swarms of Officers to [harass] our people, and eat out their substance,' the same charge the Declaration of Independence made against King George III. Obama has wielded it to further his agenda against the American people, especially against rural farmers and ranchers," Huelskamp said.

Under this extreme ruling, unelected bureaucrats and Administration appointees were essentially given a green light to rewrite the laws passed by Congress. SOPRA, however, overturns Chevron and places the power to create and interpret law back into the hands of Congress, thus restoring the proper balance of power as outlined in the Constitution.

"For seven years, Obama's unelected bureaucrats have usurped power from Congress. Elected lawmakers in Congress should make law, not unelected, unaccountable bureaucrats. SOPRA will restore the balance of powers, and most important, protect our Constitution.

"I am pleased that our legislation to rein in the bureaucracy has passed the House and that it will ultimately put the power back in the hands the people, where it belongs," Huelskamp said.

"The accumulation of all powers, legislative, executive and judicia[l] in the same hands, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly be pronounced the very definition of tyranny" (James Madison, Federalist No. 51, 1788).
