Title: Ban Smoking in Places of Employment and Public Places with Exceptions for Casinos, Cigar Bars, and Specialty Tobacco Stores

Highlights:

- Exempts Indian casinos from any requirements of the smoking ban, but notes that tribes may voluntarily prohibit smoking or enter into agreements with the state to prohibit smoking in areas of their casinos where gambling games are conducted (Sec. 12606B). - Requires "no smoking" signs to be conspicuously placed at the entrances to, as well as inside of, every building and area where smoking is prohibited, and requires all smoking paraphernalia to be removed from any nonsmoking areas (Sec. 12603). - Requires employers and food service establishments to adopt and prominently post a written nonsmoking policy (Sec. 12606). - Establishes a maximum fine of $100 for first-time violations of the smoking ban and a maximum fine of $500 for each subsequent violation (Sec. 12611).
