- Requires that any employer engaged in a state government contract who knowingly employs individuals who are neither United States citizens nor legal aliens shall have its contracts canceled, and shall be financially responsible for any costs incurred by the state as a consequence of these cancellations (Sec 2).
- Requires that all employers engaged in state government contracts must verify the immigration status of their employees via a federal database [Sec 4 (2)(b)].
- Requires that employers must meet these verification requirements [Sec 4 (2)(b)]:
- by July 1, 2008 if they employ at least 250 individuals;
- by July 1, 2009 if they employ at least 100 but fewer than 250 individuals;
- by July 1, 2010 if they employ at least 30 but fewer than 100 individuals;
- by July 1, 2011 if they employ fewer than 30 individuals
- Provides that any employer who dismisses a United States citizen or legal alien from an employment position while knowingly retaining an unauthorized alien in a similar position is guilty of a discriminatory practice [Sec 4 (3)(a)].
- Takes effect on July 1, 2008 (Sec 8).
