Vote on a bill to pose a referendum to the citizens of North Carolina to amend the Constitution prohibiting the taking of private property by the government for the purpose of private development.
-Excepts taking of "blighted" property, defined by the state of its physical condition [Section 1]. -Demands "just compensation" to be paid for properties taken under eminent domain, and extends a right to owners to obtain a jury trial to determine compensation [Section 1]. -Will, upon passage by the General Assembly, pose a constitutional amendment to the public in the form of a referendum [Section 2].
NOTE: AN AMENDMENT TO THE CONSTITUTION REQUIRES THREE-FIFTHS APPROVAL IN EACH CHAMBER FOR PASSAGE. IT MUST THEN BE APPROVED BY A MAJORITY OF CITIZENS VOTING IN THE NEXT ELECTION TO BECOME ENACTED.
