Highlights:

• Prohibits the dissemination of deep fakes within 90 days of an election in Mississippi (Sec. 1).

• Defines “deep fake” as any picture, video recording, sound recording, electronic image or any digital representation of speech or conduct (Sec. 1).

• A reasonable person would believe that depicts the speech and/or conduct of an individual who did not engage in the speech and/or conduct as presented; and

• The production was substantially dependent on technical means, rather than the ability of another individual to physically or verbally impersonate such an individual.

• Specifies that individuals found to have violated this bill shall be subject to a prison sentence of up to 5 years and a $10,000 fine or both (Sec. 1).

• Specifies that the provisions of this bill shall take effect beginning July 1, 2024 (Sec. 2).
