Title: Requires Paid Signature Gatherers to Disclose that They are Being Paid

Highlights:

  • Requires any person who accepts payment to circulate a petition for an initiative or referendum prior to accepting a signature both verbally notifying a potential signatory and printing on each page of any petition for an initiative or referendum (Sec. 1). 

  • Establishes that any person circulating a petition, in line with this act, must wear a badge that says “paid petition circulator” and is visible to any potential signatory (Sec. 1). 

  • Specifies that each and every sheet of every petition containing signatures shall be verified by the person who circulated the petition sheet and his or her affidavit (Sec. 1). 

  • Requires the county clerk to examine each petition and strike from the petition any names for which he has determined that name, address, or signature does not match and confirm the identifying information to ensure the petition conforms to all other provisions (Sec. 1). 

  • Establishes that the county clerk must deliver the petition with his certificate attached (Sec. 1). 

  • Specifies that any petition whose signatures are obtained by persons who are not residents of Idaho or are not at least 18 years of age is to be void (Sec. 1). 

  • Prohibits the use of electronic signatures, only physical signatures are authorized  (Sec. 1). 

  • Expands that the provisions of the act are declared severable if the application of the provision is declared invalid (Sec. 2). 

  • Authorizes the act to take effect on and after July 1, 2024 (Sec. 3).
