a vote to pass a bill that establishes a cause of action for persons suffering damages arising from illegal sale of marketing of illegal firearms

Highlights:

• Requires a firearm industry member to do the following (Sec. 2): 

• Establish and enforce reasonable controls; and 

• Take reasonable precautions to ensure that the firearm industry member does not knowingly sell a firearm product to a downstream distributor. 

• Prohibits a firearm industry member from sale of a firearm-related product that is likely to create an unreasonable risk of harm to the public health and safety of the state (Sec. 3). 

• Establishes the following as admirable dangerous and likely to create an unreasonable risk of harm (Sec. 3) : 

• The firearm-related product features are most suitable for assaultive purposes instead of lawful self-defense, hunting, or other legitimate sports; 

• The firearm-related product is designed in a manner that foreseeably promotes the conversion of legal firearm-related products to illegal; and

• The firearm-related product is designed to target minors or other individuals who are legally prohibited from accessing firearms. 

• Authorizes a person who has suffered harm in the State approximately caused by a firearm industry member’s intentional or knowing violation of requirements to bring action or injunctive relief in court (Sec. 4). 

• Establishes the following as exemptions to this act (Sec. 8) : 

• Bringing about action by a person who was injured while committing a crime; 

• The scope of any cause of action available to a person is not limited to what is established in this act; 

• Action is not required for self-inflicted injury that results from reckless wanton or willful discharge of a firearm-related product (Sec. 8).
