Vote to pass a bill that prohibits companies from selling vaping products that are made to look like everyday household items in the state of Illinois.

  • Prohibits a manufacturer, distributor, or retailer from advertising or promoting electronic cigarettes as a modified risk tobacco product by the FDA (Sec. 1). 

  • Specifies that manufacturers are in violation of this act if they advertise that electronic cigarettes provide smoking cessation benefits to consumers unless it has been approved by the FDA for such purposes (Sec. 1). 

  • Prohibits the use of fraudulent or misleading statements when marketing electronic cigarettes (Sec. 1). 

  • Establishes the following as misleading statements: 

    • Encouraging a person under 21 years of age to use electronic cigarettes; 

    • Has cartoons or images related to children's advertisements; or 

    • Has video games, movies, and videos of animated television shows which is primarily meant for persons under 21 years of age; or

    • Anything likely to cause a parent, legal guardian, or teacher to mistake the electronic cigarette for a product that is not a tobacco product.
