Title: Amends the Mobile Landlord and Tenant Act

Vote to pass a bill that amends the Mobile Landlord and Tenant Act in Illinois to authorize the right of first refusal for residents or a homeowners association in the park.

Highlights:

  • Requires the home park land owners, who intend to discontinue the use of the land as a mobile manufactured home park, to give a written notice by first class mail addressed to each mobile manufactured home (Sec. 1).

  • Specifies that if an owner of a mobile manufactured home gives the park owner a written notice that the owner resides in a place other than the owners unit they shall send it first class mail to the address provided (Sec. 1). 

  • Expands that the notice must include a statement advising the recipient of the intended discontinuance of the use or sale and shall be mailed or delivered at least 120 days prior to the discontinuance of the use of land (Sec. 1). 

  • Establishes that within 60 days after the notice has been mailed, any association representing 33% or more of the units in the park may notify the owner of the park that it is interested in purchasing the mobile manufactured home park (Sec. 1). 

  • Specifies that if such notice is given the association shall have 365 days after the notice has been given to purchase the park (Sec. 1). 

  • Establishes that upon the request of the association, the Department of Public Healht shall assist the association  in developing financing for the purchase of the park (Sec. 1). 

  • Requires that if the 2 parties cannot agree upon one appraiser, either party may notify the other of such disagreement (Sec. 1). 

  • Expands that the park owner shall choose an appraiser and the 2 appraisers shall choose a third appraiser, all 3 appraisers shall establish a value of the park (Sec. 1). 

  • Establishes that if the park owner refuses to select an appraiser within 15 days of the notice, the Department of Public Health shall choose an appraiser (Sec. 1).
