Title: Expands the Zoning Powers of Countries
Vote to pass a bill that expands the zoning powers of counties and adjusts the scope of accommodation tax laws in the state of Hawaii.
Prohibits 30 to 89-day home rentals, or their advertisements, in any district on Oahu (Sec. 1).
Authorizes counties to guide the overall future development of local jurisdiction (Sec. 1).
Specifies and clarifies the following as the county authority:
Regulate the time, place, and manner in which uses of land and structures may take place;
Phase out transient vacation rental units in any zoning area; and
Expand the transient accommodations tax law.
Establishes the following as zoning powers granted by ordinance (Sec. 1):
Areas within which agriculture, forestry, industry, trade, and business may be conducted;
Residential areas; and
Areas bordering natural watercourses, channels, and streams in which trade or industries fill or dump;
The location, height, bulk, and number of stores of a building;
The location of roads, schools, and recreational areas;
The density and distribution of the population;
Size of yards, courts, and other open spaces; and
Other regulations the board deems necessary.
Requires any civil fine or penalty provided by ordinance to be imposed by the district court or zoning agency (Sec. 2).
Authorizes injunctive reliefs ordered by the circuit court to supersede a proceeding (Sec. 2).
