Title: Prohibits the Sale of Beverages on Private Property

Vote to pass bill that prohibits the sale of beverages on private property.

Highlights:

  • Prohibits local health departments from adopting or enforcing a law that regulates the sale of lemonade or other nonalcoholic beverages from a stand on private property by an individual who is less than 18 years of age (Sec. 1). 

  • Establishes that any individual who sells lemonade or other nonalcoholic beverages from a stand must comply with the following:

    • Obtain the permission of the owner, tenant, or lessee of the private property; and

    • Not operate a stand on more than 2 consecutive days nor operate more than 8 days in a 30 day period. 

  • Requires that the lemonade stand is not positioned at the following (Sec. 1): 

    • Hospitals; 

    • Health facilities; 

    • Housing services establishments that are required to file disclosure statements; 

    • Care retirement communities; 

    • Community mental health center; 

    • Private mental health institutions; 

    • Areas designed to provide food under the nutrition service program; 

    • A food pantry that: 

      • Operates with a nonprofit organization; or

      • Distributes food which may include food from the United States; Department of Agriculture.
