Title: Increases Various Corporate Trespass Laws and Penalties and Limits Whistleblowing

Vote to pass a bill that increases various corporate trespass laws and penalties and limits whistleblowing in the state of Kentucky.

Highlights:

  • Establishes that a person commits the offense of trespass on key infrastructure assets if they knowingly enter or remain unlawfully in or upon the real property on which key infrastructure assets are located (Sec. 1). 

  • Prohibits a person from knowingly using, retaining, or authorizing a person to use an unmanned aircraft system to fly above real property on which key infrastructure assets are located with the intent to cause harm or damage surveillance (Sec. 1).

  • Establishes the recording, distributing, photographically electronically or otherwise of a key infrastructure asset to be in violation of this act (Sec. 1). 

  • Requires that any trespassing on a key infrastructure asset be a Class B misdemeanor for first-time offenses (Sec. 1). 

  • Authorizes unmanned aircraft systems to be used by (Sec. 1):

    • The owner of the real property of key infrastructure assets; 

    • A person under a valid lease, servitude, right of use permit; 

    • A third party who is authorized by a person; 

    • A law enforcement agency, emergency medical service agency, hazardous material response team, disaster management agency; 

    • Person in compliance with the applicable federal Aviation Administration authorization; 

    • Satellite orbiting;

    • A person acting on behalf of an insurance company for the purposes of underwriting an insurance risk; or 

    • Any electric, water, natural gas utility company or person acting on behalf of their company for legitimate business purposes.
