Title: Prohibits Disruptive Protests Inside the State Capitol
Vote to pass a bill that prohibits disruptive and criminalizes protests inside the state capitol in Kentucky.
Establishes that a person is considered guilty of interference with legislative processing in the first degree when there's intent to disrupt, impede, or prevent the General Assembly from conducting business (Sec. 2).
Requires that any interference with a legislative proceeding in the first degree to be charged with a Class A misdemeanor for first time offenders and a Class D felony for second and subsequent offenses (Sec. 2).
Establishes the following as intent to disrupt, impede, or prevent the General Assembly from conducting business:
Enters into or remains inside a room;
Conspires to enter into or remain inside;
Facilitates another person entering or remaining inside a chamber of the General Assembly;
Conspires to obstruct or impede; or
Facilitates another person obstructing or impeding a legislator, legislative officer, or legislative staff member.
Authorizes a peace officer to make an arrest instead of issuing a citation for a misdemeanor committed in their presence (Sec. 2):
An offense where the defendant poses a risk of danger to himself or others; or
During the defendant's refusal to follow the peace officer’s instruction.
Establishes that a police officer can issue a citation instead of making an arrest for a violation committed in their presence (Sec. 2).
