Title: Expands Codes Related to Official Misconduct

  • Establishes that a public servant is guilty of a misconduct when intending to obtain personal benefit or cause harm to another person if they knowingly (Sec. 1): 

    • Commit an unauthorized exercise of official functions; 

    • Refrains from deforming duty; 

    • Performs an official function in a way to benefit the public servant’s own property; 

    • Acts in a way intended to practice discrimination on the basis of race, religion, color, disability; and

    • Uses the public servant’s position of trust to engage in criminal conduct. 

  • Requires any violation of the aforementioned conduct to be punishable by a Class A misdemeanor (Sec. 1). 

  • Establishes a class F felony if the value of personal benefit received, or harm caused, is more than $1,500 (Sec. 1).
