Vote to pass a bill that prohibits distributing, maintaining, or providing internet hosting services for a foreign adversary controlled application (e.g., TikTok).

Highlights:

• Prohibits distributing, maintaining, or providing internet hosting services for a foreign adversary controlled application (e.g., TikTok), but exempts a covered application that executes a qualified divestiture as determined by the President (Sec. 2).

• Exempts the aforementioned prohibitions shall not apply to an application that is primarily use to post product news reviews, business reviews, or travel information and reviews (Sec. 2).

• Specifies that under this bill a foreign adversary controlled application is defined as the following including being directly or indiretly operated by (Sec. 2):

• ByteDance, Ltd, or TikTok (including their subsidiaries or successors); or

• A social media company that is controlled by a foreign adversary and has been determine by the President to present a significant threat to national security

• Authorizes the Department of Justice to investigate violations of the bill and enforce the bill’s provisions, and specifies that entities that violate this bill shall be subject to civil penalties based on the number of users (Sec. 2).

• Requires a covered application provide a user with all available account data (inlcuding posts, photos, and videos) at the user’s request before the prohibition takes effect (Sec. 2).

• Specifies that the U.S. Court of Appeals for the District of Columbia shall have exclusive jurisdiction over any challenge to the bill, and requires challenges to be brought within 165 days of the bills enactment date, and any challenges to any action, finding, or determination under this bill be brought within 90 days (Sec. 2).
