Title: Requires Employer Use of the E-Verify System for Employee Hiring
Vote to pass a bill that requires employers use the E-Verify system for employee hiring in the state of Iowa.
Prohibits an employer from knowingly employing an unauthorized non U.S. citizen (Sec. 2).
Requires any court attorney, local law enforcement officer, or member of the public to file a complaint of violation if there is evidence that an employer has knowingly employed an unauthorized non U.S. citizen (Sec. 2).
Establishes that any violation of the aforementioned will result in the court (Sec. 2):
Terminating the employment of an unauthorized non U.S. citizen;
Subjecting the employer to a three year probationary period;
Requiring the employer to file quarterly reports with the department for each new employee; and
Ordering the appropriated agencies to suspend all licenses that are held by employers if they fail to file affidavits with the department.
Authorizes the court to consider the following factors when suspending the employers license (Sec. 2):
The number of unauthorized U.S. citizens employed by employer;
Prior misconduct by employer;
Degree of harm from violation;
Duration of the violation; or
Role that the employer played in the violations.
Requires the district court to consider the federal government’s determination of the immigration status of the employee (Sec. 2).
Authorizes the secretary of state to maintain copies of court orders (Sec. 2).
Requires any employer after hiring or rehiring an employee to verify the employment of the employee through an e-verify program (Sec. 3).
Requires the secretary of state to request from the United States homeland security a list of employers from the state that are registered with e-verify programs, every three months (Sec. 3).
