Title: Establishes the Second Amendment Financial Privacy Act

Vote to pass a bill that establishes the Second Amendment financial privacy act and protects card payments involving firearms and ammunition in the state of Ohio.

Highlights:

  • Prohibits any government entity or official from knowingly keeping or causing any list, record, or registry of privately owned firearms or the owners of those firearms (Sec. 1). 

  • Prohibits any of the following financial institutions or agents from (Sec. 1): 

    • Requiring firearms codes in a way that distinguishes a firearms retailer from other retailers; or

    • Declining a payment card transaction involving a firearms retailer based solely on the assignment of firearm codes. 

  • Establishes that the financial institution is not limited when negotiating with responsible parties (Sec. 1). 

  • Authorizes the attorney general to investigate any reasonable allegations that a person or entity has possession of firearm records that aren’t involved in a criminal investigation or prosecution (Sec. 1). 

  • Specifies that if any individual purposely fails to comply with an injunction issued a civil fine of an amount not exceeding one thousand dollars per violation will be imposed on the violator (Sec. 1). 

  • Establishes this to be known as the Second Amendment Financial Privacy Act (Sec. 2).
