Title: Prohibits Revenge Porn and Increases Penalties

Vote to pass a bill that prohibits all revenge porn and increases penalties in the state of Oregon.

Highlights:

  • Establishes that any proceeding for a violation of a restraining order must be conducted by the court that issued the order, or by the circuit court (Sec. 1). 

  • Establishes that any individual who has experienced sexual abuse and reasonably fears for their safety may petition the circuit court for a restraining order under the following conditions (Sec. 3): 

    • The person and the respondent are not family or household members; 

    • The respondent is at least 18 years of age; or 

    • The respondent is not prohibited from contacting the person pursuing the restraining order. 

  • Requires the respondent to file a restraining order in the county where the abuse occurred (Sec. 3). 

  • Establishes that the petition may be filed without the appointment of a guardian by a respondent who is at least 12 years of age or by a parent, or lawful guardian, of a person who is under 18 years of age (Sec. 3). 

  • Establishes the criteria for unlawful dissemination as the following (Sec. 4):

    • The person has the intent to harass, humiliate, or injure the other person; or 

    • The perpetrator knows the other person did not consent. 

  • Defines unlawful dissemination of an intimate image as a Class A misdemeanor (Sec. 4). 

  • Establishes unlawful dissemination of an inmate image if the person has prior had a conviction at the time of the offense to be a Class C Felony (Sec. 4). 

  • Authorizes the act to take effect upon its passage (Sec. 6).
