Title: Establishes a Procedure for Issuing Extreme Risk Protection Orders
Vote to pass a bill that establishes a procedure for issuing extreme risk protection orders to people who are a danger to the others in the state of New Hampshire.
Authorizes a petitioner to seek relief in the county where the petitioner or respondent resides alleging that the respondent poses a significant risk to himself or others (Sec. 1).
Requires the petition to include a written affidavit signed by the petitioner under oath (Sec. 1).
Requires the petition to specify all quantities, types, and locations of firearms that the respondent currently owns (Sec. 3).
Establishes no filing fee or fee for service of process for the petitioner (Sec. 3).
Authorizes the petitioner to request a temporary extreme risk protection order, with or without the actual notice of the respondent (Sec. 4).
Authorizes the court to issue a search warrant, authorizing a law enforcement officer to search and seize any firearms in the respondents possession (Sec. 5).
Establishes that any false allegation from the petitioner with the intent to harass the respondent will be guilty of a class A misdemeanor (Sec. 11).
Specifies that if a person knowingly violates an extreme risk protection order, they will be guilty of a class B felony (Sec. 12).
Requires the circuit courts to report to the administrative office specifics pertaining to extreme risk protection orders petitions issued or denied (Sec. 14).
Establishes the effective date of the act as January 1, 2025 (Sec. 13).
