Title: Prohibits Foreign Governments from Owning Agricultural Land in the State

Vote to pass a bill that prohibits agricultural land ownership by the governments or nationals of Iran, Russia, North Korea, Cuba, Venezuela and China.

Highlights:

  • Defines terms related to foreign entities and agricultural land (Sec. 1). 

  • Requires individuals who are required to fill out a USDA form concerning foreign investment to fill out a copy with the department of agriculture and natural resources  (Sec. 2). 

  • Specifies the following provisions are in effect (Sec. 3). 

    • A prohibited entity may not own agricultural land; 

    • A prohibited entitled may not lease agricultural land unless the lease is exclusively for research purposes or the lease is exclusively for contract feeding of livestock owned by a family farm unit;  

    • Foreign entities may not won more than one hundred and sixty acres of agricultural land in the state with exceptions for inheritance; 

    • Excluding prohibited entities, there is no restriction on easements or the number of acres of agricultural land that a foreign entity or government may own 

    • Specifies that this does not apply to foreign entities whose right to hold land are secured by a treaty 

  • Specifies that any foreign entity that is in violation of this act via agricultural land must transfer ownership of the land within three years (Sec. 4). 

  • Specifies that any agricultural land owned in violation of this chapter is forfeited to the state (Sec. 6).
