Title: Amends Previous Law to Try Juveniles as Adults for Gun-Related Felonies

Vote to pass a bill that amends violent offender definitions and rules in the state of Kentucky.

Highlights:

  • Establishes definitions for what constitutes a “violent offender” (Sec.1) 

  • Prohibits any violent offender who align with the following descriptions from being released from probation unless they have served at least 85% of the sentence imposed (Sec. 1):

    • A violent offender who has been convicted of a capital offense, Class A felony, or Class B felony; 

    • If the victim was clearly identifiable as a peace officer, firefighter, or emergency medical personnel; or

    • If the victim died as a result of overdose. 

  • Establishes that any violent offender that is convicted of a Class C felony shall not be released on probation without serving at least 50% of their sentence imposed (Sec. 1) 

  • Establishes that any child charged with a felony in which a firearms is present will be transferred to the Circuit Court for a trial as an adult if the following occur (Sec. 1): 

    • The child committed a Class A, B, or C felony; 

    • The firearm was used in commision to the felony; and 

    • The child was 15 years or older at the time of the alleged felony. 

  • Authorizes the Circuit Court to subject the same penalties as an adult offender (Sec. 1). 

  • Establishes that if the child is convicted in the Circuit Court, they must return to sentences in the Circuit Court for proceedings and will not be eligible for probation or discharge (Sec. 1).
