Title: Amends Penalties for Lewd Conduct with a Minor

Vote to pass a bill that amends penalties for lewd conduct with a minor and authorizes the death penalty.

Highlights:

  • Establishes that any person accused of attempting to sexually arouse a child, person under 18, will be charged with a felony (Sec. 1). 

  • Requires that the offender serves a term in prison, of not more than life, if the minor is under the age of 16, but older the age of 12 (Sec. 1). 

  • Establishes that if the child is under the age of 12 the offender shall be punished by death or by imprisonment for life (Sec. 1). 

  • Authorizes a jury, or court of jurors that finds the death penalty to be unjust they may impose a life sentence, in all cases withstanding the following:  (Sec. 2). 

    • The defendant was guilty of a prior murder;

    • If the offender knowingly risk of death to many persons; 

    • The murder of a child under 12 was especially heinous, atrocious or cruel; 

    • The murder was committed during an attempt to penetrate; or

    • It was committed against a former or present peace officer. 

  • Establishes that the act will be in full force on July 1, 2024 (Sec. 3).
