Highlights:

  • Requires mandatory minimum sentences for individuals convicted of trafficking fentanyl (Sec. 2).

  • Increases mandatory minimum sentences for fentanyl trafficking to the following (Sec. 2):

    • For between 4 and 14 grams of fentanyl (100-200 pills) a prison term of no less than 3 years and fine of not more than $10,000;

    • For between 14 and 28 grams of fentanyl (250-500 pills) a prison term of no more than 5 years and fine of no less than $15,000;

    • For 28 grams of fentanyl (500+ pills) or more a prison term of no more than 10 years and fine of no less than $25,000; and

    • A maximum sentence of life imprisonment and $100,000 fine for a drug induced homicide.

  • Specifies that the provisions of this bill shall take effect immediately July 1, 2024 (Sec. 4).
