Vote to pass a bill that establishes the crime of unlawful dissemination of another individual's image and the private right of action for such an offense.
Establishes the crime of unlawful dissemination of another individual's image and authorizes the private right of action for such an offense (Sec. 1).
Defines the following details as qualifying, including when individuals (Sec. 1):
Create or disseminate a still or video image of the victim on a social media platform without their consent;
Are identifiable from the still video or video image or from information displayed in connection with the still or video image;
Suffered physical injury as a result of a sex offence, serious physical injury as a result of a non-sex offence, or death, and this injury is depicted in the image; and
Committed, participated in the commission of, or conspired to commit the crime that resulted in such injury to the victim.
Specifies that an individual also unlawfully disseminates a personal image when they act as an agent of the actor who created an image and they knowingly disseminated or published such an image (Sec. 1)
Specifies that the provisions of this bill shall become effective immediately upon passage and approval by the governor (Sec. 1).
