Vote to pass a bill that amends medical malpractice rules.

Highlights:

• Define terms related to the New Mexico Healthcare System (Sec. 1). 

• Specifies requirements for health care provider to be covered under the New Mexico Medical Malpractice act including the following (Sec. 2):  

• Establishing financial responsibility; and

• Pay the surcharge. 

• Specifies that an independent outpatient facility shall establish increased financial responsibility up to $500,000 (Sec. 2). 

• Authorizes the superintendent to arrange actuarial studies to determine appropriate amount of coverage for hospital controlled outpatient facilities (Sec. 2). 

• Specifies that hospitals who don't not meet coverage shall not have the benefit of any of the provisions of the medical malpractice act (Sec. 2). 

• Specifies amounts that are recoverable according to the year and dollar amount (Sec. 3). 

• Defines what an “occurrence” means (Sec. 3).
