Title: Requires Probable Cause for a Police Body Search
Vote to pass a bill that requires the State Department of Corrections document probable cause that an incarcerated individual is concealing contraband prior to a body search.
Requires that the Commissioner of Correction or the commissioner’s designee shall notify each victim of any crime when a person who is incarcerated transfers from one correctional facility to another correctional facility, if the victim has provided the Commissioner of Correction with a valid residential address or electronic mail address (Sec. 1).
Requires that on or before February 1, 2024, the Commissioner of Correction must submit a report considering body scanning machines and specifies that the report must include the following, including, but not limited to (Sec. 2):
The status of obtaining body scanning machines;
The estimated costs of installation and use of body scanning equipment;
Recommendations on the amount of body scanning machines;
Information regarding the health effects of using the body scanners caused by radiation exposure; and
The effects and benefits of implementing body scanners specifically in relation to bringing contraband into correctional institutions.
Requires that on or before February 1, 2024, the Commissioner of Correction must issue a request for proposal for obtaining a body scanning device (Sec. 2).
Specifies that body scanning devices shall be used for the following purposes (Sec. 2):
Allow correctional facility to easily find contraband; and
Reduce the number of strip searches conducted to find contraband.
