Title: Increases Penalties for Fentanyl Dealers and Manufacturers

Vote to pass a bill that increases penalties for fentanyl dealers and manufacturers.

Highlights:

  • Requires a person that commits a first degree felony to serve a 3 year mandatory minimum, if (Sec. 1):

    • The person sells, manufactures, or delivers or has the intent to do so with alfentanil, carfentanil, fentanyl, or sufentanil in any form; or

    • The substance or mixture above is made to resemble branded food products, candy, cereal, gelatin based products, or contains a cartoon character. 

  • Requires an adult who knowingly sold or delivered 4 grams of any of the substances listed above to a minor to (Sec. 2):

    • Serve up to 25 years in prison but no more than a life imprisonment; and

    • Pay a fine of $1 Million if the substance resembles branded food products, candy, cereal, gelatin based products, or contains a cartoon character.
